Richie Sambora May Not Have Been DUI

Richie_sambora Several sources who were with Richie Sambora the night of his DUI arrest expect his blood alcohol to be under California's .08 limit.  They told TMZ Richie simply didn't "drink much at all" before the cops stopped him 

What doesn't make sense to me is why didn't he just take the breathalyzer and be done with it?  Why wait for a blood test?  Had he taken the breathalyzer and not blown .08 the arrest would never have happened.

Sources also indicate Heather Locklear does not plan to take Richie to court to have his visitation scaled back.  They indicate Heather currently has her own issues, but also that Richie is generally a very good dad.  He has reportedly flown from Bon Jovi concerts in Japan to see Ava play softball.

The people who say stuff like "but he didn't drink much at all!" generally have no idea just how very easy it is to go over the legal limit. Because it really doesn't take "much at all" to blow a .08, even for a big tough guy.

Too true Amy. And who really pays attention to how much someone else is drinking, unless you are trying to get in their pants.

Maybe I'm making this up, but can't breathalyzer tests be inaccurate, where you're sure to get an accurate reading with a blood test?

Yes, the on-site breathalyzers can be wildly inaccurate, but the one they issue on the street is rarely (if ever) used in court. It's optional and is mostly just to justify arresting the person. They make you blow again at the station (with a big, more accurate machine) and this is one that is used as evidence. But most of the time, they're arresting you anyway, whether you refuse the test or not. If he really WAS sober, then he should have taken it like Jodi said, and avoided the whole arrest. Refusing the test kind of suggests he was trying to stall and was hoping his levels would drop in the time it took to get a blood test.

I don't know. I have a lot of friends who constantly argue about the best way to handle a DUI check (always cooperate vs. always refuse, etc.) but I believe the best way is actually to call a damn cab.

This happened to someone I know...and he refused the breathalizer test, because he had heard it was the right thing to do (no idea if it actually is, but there are plenty of non-idiotic people who believe it).

After spending one of the worst nights of his life being treated like scum and sitting in jail, his blood test came back as .01. Sometimes cops are wrong.
